Yesterland Farm Operation, LLCAssumption of Risks, Waiver Release, and IndemnityIn consideration of the services of Yesterland Farm, I, as an adult (18 years or older) guest, or the parent or legal guardian of a guest who is a minor (the child), acknowledge and agree as follows:Yesterland Farm is an outdoor agri-entertainment venue that features many entertainment attractions and activities in a rustic farm and ranch setting. As such, as a guest of Yesterland Farm I understand that I will encounter conditions at Yesterland Farm consistent with a farm and ranch setting, including but not limited to unpaved dirt or gravel walkways, dirt, mud, gravel, gravel, rocks, wooden decks, fences, walkways, livestock and other farm animals. I understand that as part of my experience at Yesterland Farm I will have access to certain attractions, including but not limited to slides, jumping pillow and other playground equipment that can be dangerous and include the inherent risks of falls and collisions with other persons, structures or equipment, resulting in breaks, sprains and other trauma, that can be severe or debilitating.I assume ALL risks of attractions and use of any equipment, whether or not described above; and if the guest is my minor child or ward, I have discussed the risks with the child who understands them and wishes to participate, nevertheless. Additionally, on behalf of the minor child or ward, I assume ALL risks of attractions and use of any equipment, whether described above or not.WAIVERFor myself, and if the guest is my minor child or ward, on behalf of the child, I waive and forever relinquish the right to seek recovery from Yesterland Farm Operation, Peerless Production Group and their respective owners, members, directors and staff, agents and representatives for any and all claims of personal injury, death or other loss, suffered or caused by me or the child, related in any way to my, or the child’s, use of one of the aforementioned attractions.RELEASE AND INDEMNITY*PLEASE READ CAREFULLY*I FURTHER FOR MYSELF, AND IF THE GUEST IS MY MINOR CHILD OR WARD, ON BEHALF OF THE CHILD AGREE TO RELEASE, NOT TO SUE, AND TO INDEMNIFY (PROTECT) YESTERLAND FARM OPERATION, PEERLESS PRODUCTION GROUP AND THEIR RESPECTIVE OWNERS, MEMBERS, DIRECTORS AND STAFF, AGENTS AND REPRESENTATIVES (“RELEASED PARTIES”) WITH RESPECT TO ANY AND ALL CLAIMS OF PERSONAL INJURY, DEATH OR OTHER LOSS, SUFFERED OR (FOR THE PURPOSES OF INDEMNITY) CAUSED BY ME OR THE CHILD, RELATED IN ANY WAY TO MY, OR THE CHILDS, USE OF ANY PART OF DEWBERRY FARMS. THIS AGREEMENT INCLUDES PREPARATIONS TO RIDE THE ATTRACTIONS. IT ALSO INCLUDES CLAIMS OF NEGLIGENCE, WHETHER THE SOLE NEGLIGENCE OR PARTIAL NEGLIGENCE (BUT NOT GROSS NEGLIGENCE OR INTENTIONALLY WRONGFUL CONDUCT) OF THE RELEASED PARTIES.By signing this Assumption of Risks, Waiver, Release and Indemnity, I acknowledge that I have read it and have agreed to all the terms and conditions.Tickets are non-refundable and all sales are final. Operating hours are subject to change. Operating hours for specific Attractions and Food locations may vary from Farm Operating hours. Attractions and rides are subject to availability and may not operate due to inclement weather, mechanical difficulties, or the time of year. 2026 Season Passes, and any non Field Trip specific ticket is not valid on School Field Trip days. Season Passes are non-transferable and expire after December 27th, 2026. There may be a $2.00 fee per ticket, for any date or time changes we are requested to make to your original order. Please check our website for details and scheduled operating hours.All Ticket Holders grant Yesterland Farm Operations, LLC the right to film, video, or photograph Ticket Holders for any purpose whatsoever without any payment or compensation of any kind. In the event of a mechanical failure or inclement weather, such as electrical storms, heavy rain, or high winds, Yesterland Farm may close any attractions without notice until the weather has cleared.**Some attractions may have height, weight, or age restrictions.**Tickets are valid for one day only (Unless a Season Pass). Ticket Holder must have their hand stamped for re-entry if they leave the farm and would like to return the same day.Tickets canot be duplicated. If a copy is made, the first scanned ticket will allow entry and anyone using a duplicated ticket will be denied admission. Farm staff will check a photo id for verification.All tickets/Season Passes are non-refundable. Ticket Fees are also non-refundable.Tickets may be exchanged for a different day if done so before the day the ticket is valid for. There is a $2.00 change fee per ticket for changting date. Tickets may only be exchanged for the current calander season and not for another season.The holder of this ticket assumes all responsibilities for any risk of bodily harm or loss of property sustained while attending this attraction, and waives all rights to lay claim for any damages resulting from any cause whatsoever either before, during, or after the attraction.Under Texas law (Chapter 75A, Civil Practice and Remedies Code), an Agritourism Entity is not liable for any injury to or death of an Agritourism Participant resulting from an Agritourism Activity.Smoking and Vaping Free FarmFor safety and health purposes, along with being courteous to all guests, there is no smoking or vaping, including e-cigarettes allowed anywhere on the farm including the parking lot. About Doggies at the FarmWe love our furry friends! We allow socialized and personable doggies into the farm. Unfortunately, our insurance policy does not allow any dog trained or used as an attack or guard dog; or any breed of dog that has a prior history of biting. We reserve the right to ask any dog to be removed due to observed aggressive behavior.Dogs are not allowed to enter the corn maze and must remain on a leash with their owner at all times. We also require that you pick up after you dog's recycling process. Nobody wants to step in that.Picnics at YesterLand FarmYou are welcome to bring a picnic to have while you are here on the farm. We have lots of picnic tables and they are on a first come, first serve basis. Campfire sites are available upon reservation only. We also can provide ants for your picnic, if requested.Some Non-Negotiable No-NosNo alcoholic beverages (especially not Moonshine). No outside barbecue grills or campfires. However, we do have campfires that you may reserve online! Yahoo for campfire time!No drones are allowed for safety reasons.Rain Check PolicySometimes it rains on our parade…or in our case, the farm. Believe us, we want to have as much fun as everyone else, but sometimes we have to close for safety. Rain Checks will be given if the weather does not enable the farm to operate safely and we have to close for the day. Rain Checks will be valid for weekends during the same season. All Rain Checks are issued at the discretion of YesterLand Farm. In the event the farm cannot operate safely and must be closed for the day, please report to the Groups Guest Service Shack. Your receipt must be provided to receive a Rain Check. List the names of each individual in your party, along with each Pass purchased corresponding to your receipt. A card will be given with instructions for your return visit. Please present this card along with the ID of each member of your group (excluding children) to the Groups Guest Service Shack when you return the next sunny day.
